Oracle told partners it may miss its own deadline on a giant New Mexico data center, and it wants cover against the payment fallout.
Oracle has issued a force majeure notice on its Stargate data center project in New Mexico. The notice centers on the facility's 2028 target to come online. Invoking force majeure typically lets a company pause certain contractual obligations, including payments, if it can show the delay stems from circumstances outside its control. Oracle has not said publicly what those circumstances are.
Force majeure clauses exist for hurricanes and wars, not for slow permits or backordered turbines. Oracle reaching for one on a project carrying the Stargate name, shorthand these days for some of the industry's biggest AI infrastructure bets, looks less like bad luck and more like an early hedge against a 2028 date that was always going to be tight.
If the company behind one of the largest data center buildouts in the country needs an escape hatch three years ahead of schedule, smaller operators racing to build AI capacity should not assume they will do any better.
